DISTANCE SALES AGREEMENT

1.2 - Buyer


End Consumer (Customer)

 

2 - Subject of the Agreement


The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of goods or services ordered electronically by the Buyer through the www.bycperformance.com website, in accordance with the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

The Buyer acknowledges and declares that they are aware of the basic characteristics of the goods/services for sale, the sales price, payment method, delivery conditions, and right of withdrawal, and that they have confirmed this information electronically.

 

3 - Contract Date and Force Majeure


The contract shall enter into force on the date confirmed electronically by the Buyer.

Circumstances beyond the control of the parties, unforeseen circumstances that prevent one party from fulfilling its obligations under the contract (natural disaster, war, fire, strike, epidemic, etc.) are considered force majeure. If the force majeure continues for 30 days, each party has the right to unilaterally terminate the contract.

 

4 - Delivery


  • Delivery costs are generally the responsibility of the Buyer. However, the Seller may undertake to cover the shipping costs for purchases exceeding a certain amount.
  • Delivery will be made as soon as possible, depending on stock availability. The Seller will deliver the goods within 35 days at the latest.
  • If the price is not paid or is cancelled in bank records, the Seller is released from its delivery obligation.

 

5 - Seller's Rights and Obligations


  • The Seller is obligated to deliver the product subject to the contract complete, in accordance with the specifications specified in the order, and with any warranty documents, if any.
  • The Seller is obligated to refund the price within 14 days of receiving the product, within the scope of the right of withdrawal.
  • If performance becomes impossible, the Seller shall immediately notify the Buyer and refund the paid amount within 10 days at the latest.

 

6 - Buyer's Rights and Obligations


  • The Buyer is deemed to have accepted the terms of the contract by placing an order.
  • The Buyer is obligated to inspect the product before receiving it. Damaged or defective products must not be accepted, and a report must be filed with the courier.
  • The Buyer is obligated to protect the product with care after delivery.
  • The Buyer must notify the Seller in writing or via permanent data storage if they wish to exercise their right of withdrawal.

 

7 - Product Specifications


The type, type, quantity, brand/model, color, and sales price (including all taxes) of the product to be ordered are specified on the promotional page at www.bycperformance.com and on the invoice.

 

8 - Payment

  • Payments are made via credit card, money order/EFT, or the method specified by the Seller.
  •  For installment purchases made with a credit card, the bank's installment terms apply.
  • The order number must be stated for money order/EFT payments.

 

9 - Right of Withdrawal


  • The Buyer has the right of withdrawal within 14 days from the date of receipt of the product.
  •  When exercising the right of withdrawal, the product must be returned to the Seller along with the invoice.
  • Returns will not be accepted if the product/packaging is damaged, used, or not in a resalable condition.
  • Exceptions to the right of withdrawal (personalized products, etc.) are specified in the Distance Contracts Regulation.

 

10 - Warranty


The warranty period and terms for the products are specified on the product promotional page. If the product is under warranty, the manufacturer/supplier terms and conditions apply.

 

11 - Privacy


Personal data received from the Buyer is processed in accordance with the KVKK and relevant legislation. The Seller does not share personal data with third parties; it may only disclose it to official authorities if legally required to do so.

 

12 - Dispute Resolution


In disputes that may arise from this agreement:

  • Consumer Arbitration Committees, depending on the price of the purchased product,
  •  Consumer Courts, for higher prices, have jurisdiction.

 

13 - Enforcement


By placing an order through www.bycperformance.com, the Buyer is deemed to have accepted all the terms of this agreement.
